Terms & Conditions of Clinician On A Mission

Welcome to the website of Clinician On A Mission. These Terms of Service (“Terms”) govern your access to and use of our websites, including any subdomains, services, and portals associated with (collectively, the “Websites”).

By accessing or using the Websites, you agree to comply with these Terms, as well as any additional policies referenced herein, including but not limited to the Privacy Policy. If you do not agree to these Terms, you may not use the Websites.

For the purposes of these Terms:

• “Clinician On A Mission,” “We,” “Us,” and “Our” refer to Clinician On A Mission.

• “You” and “Your” refer to any individual or entity accessing or using the Websites.

Your use of the Websites is subject to these Terms, and by continuing to access or use the Websites, you confirm your acceptance of any modifications or updates to these Terms, which we may make from time to time. It is your responsibility to review the Terms periodically for any changes.

User Accounts and Portal Access

To enhance your interaction with Clinician On A Mission services, we may offer access to user accounts and client portals (“Portal”). These tools are designed to streamline communication, case management, billing, and documentation for clients. It is your responsibility to review the Privacy and Terms & Conditions of third parties to ensure you understand the conditions of use. These third parties include, but are not limited to, mental health portals and dashboards used by Clinician On A Mission to deliver and manage services, payment processors, and any and all means of sign-ups for reservation systems for classes. 

Creating an Account

• You may be required to create an account to access certain features or services on the above mentioned Websites. The third party websites and online portals used by Clinician On A Mission may be changed after you complete enrollment and account registration. In order to continue receiving services with Clinician On A Mission, you will be required to complete new enrollments and account registrations, if necessary, to ensure timely billing and future scheduling of services. Failure to do so will result in discharge from services.

• When creating an account, you must provide accurate and complete information. Failure to do so may result in suspension or termination of your account.

• Your account credentials are personal to you and must not be shared with others. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

Use of Client Portal

The client Portal you maintain with a third party provides a variety of capabilities which include but are not limited to:

• Access to session history

• Managing payment method on file

• The ability to receive and complete online assessments and return them to your clinician to support an effective clinical experience

Your use of the Portal is subject to these Terms and any additional guidelines provided within the Portal.

Responsibilities of User

• You agree to use the Portal and other account features only for lawful and intended purposes.

• You must notify your clinician immediately if you suspect unauthorized use of your account or any other breach of security.

• Clinician On A Mission reserves the right to terminate services at its discretion, including for inappropriate communication(s) or interaction(s) with service provider or affiliate providers, or for misconduct, or violations of these Terms or for security purposes.

Security & Confidentiality

Clinician On A Mission is not responsible for the security and confidentiality of third party accounts and/or Portal data. It is important to know that no system is entirely secure. By using the Portal, you acknowledge and accept this inherent risk.

Access Management

• Clinician On A Mission reserves the right to discontinue services and discharge any individual from the practice if you violate these Terms or fail to comply with any applicable guidelines.

• Upon termination of and discharge from services, all outstanding balances will be charged to the payment method on file for services rendered, including for any scheduled appointment even if the session was terminated early due to inappropriate behavior or misconduct.

Online Payments

We use third-party payment processors, including Headway, Stripe, IvyPay, Venmo, Pay Pal and others as applicable, to facilitate online payments for services. By using the payment functionality on the Websites, you authorize Clinician On A Mission, and its payment processors to process your payments as necessary to provide the selected services.

Electronic Payment Method on File and Recurring Payments

In order to receive services with Clinician On A Mission, you are required to keep an electronic payment method on file as a client unless your specific service type is compensated through a grant-funded program, or other third party arrangement expressly communicated and documented via client agreements. If you engage in subscription-based services or recurring billing through the Websites, you agree to the terms and payment schedule provided at the time of purchase.

• Subscription payments will be automatically charged to your selected payment method on file at the indicated intervals.

• It is your responsibility to ensure that your payment information remains current and accurate to avoid interruptions in service. You will incur a $35 fee per each denied transaction.

Taxes

You are responsible for paying applicable taxes where required.

Legal Disclaimer

Interactions with the Websites, including the submission of forms or communications, do not guarantee a client-service provider or client-clinician relationship. For more information, please refer to our Legal Disclaimer.

Online Forms

The Websites may offer forms for submitting inquiries, scheduling consultations, or initiating services. By using these forms:

• You acknowledge that the submission of information does not create an expectation of confidentiality until a client-clinician relationship is established.

• Clinician On A Mission must review submitted information for potential conflicts of interest, ethical conflicts or contraindications before proceeding with any service or therapeutic relationship. If it is determined that there is a conflict of interest, potential dual role or other contraindication to initiate or resume services, the rationale will be documented and you will be notified. You may request assistance in identifying another suitable provider that may be a better fit for your needs.

Client Portals

Registered users may have access to secure Portals for managing their sessions.

• Access to the Portal is provided as a convenience and does not replace formal communications between you and your provider.

• You are responsible for communication directly with your provider in accordance with the Late Cancellation and No-Show Policy.

• All communications and materials shared through the Portal are subject to these Terms.

Prohibited Activities

You may not use the Websites or Portals to:

• Engage in illegal activities or violate applicable laws.

• Submit false or misleading information.

• Interfere with or disrupt the functionality of the Websites, including hacking or uploading malicious content.

Marketing and Communication

Consent to Communication

By providing your contact information through the Websites and forms, you consent to receiving communications from Clinician On A Mission. These communications may include:

• Outreach via telephone and/or email to schedule an intake appointment or clinical assessments

• Marketing communications such as emails and SMS notifications, should you choose to sign up for these, where permitted by applicable law.

Opt-Out Options

You may opt out of marketing communications at any time by following the instructions included in the message or by contacting us directly. Note that opting out of marketing communications will not affect your receipt of service-related notifications nor responsibility for outstanding balances.

Third-Party Marketing Tools

We use a variety of tools for communication and marketing. These tools process your data in accordance with their respective privacy policies. Please refer to our Privacy Policy for details on data sharing and storage.

SMS Notifications

We may send SMS notifications for limited purposes, such as appointment reminders or cancellations due to provider availability. You can opt out of receiving SMS notifications by following the instructions provided in the message or contacting us. Your provider will utilize alternate means of communication to notify you of last-minute appointment changes, such as email or phone call, if you opt out of SMS notifications. 

Ownership of Intellectual Property

All content, features, and functionality available on the Websites, including but not limited to text, graphics, logos, images, videos, and software, are the exclusive property of Clinician On A Mission or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

Limited License

Clinician On A Mission grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Websites solely for personal or professional purposes related to our services. This license does not grant you the right to:

• Reproduce, modify, distribute, or display any content from the Websites.

• Use the Websites or their content for any commercial purpose without prior written consent.

Trademarks

All trademarks, service marks, and logos displayed on the Websites, now and in the future, are the property of Clinician On A Mission or third parties. Your use of the Websites does not grant you any right or license to use these trademarks without explicit permission.

Third-Party Content

Clinician On A Mission does not own or control third-party content or websites and therefore is not responsible for the accuracy, reliability, legality or content, links, or integrations from third-party platforms.

General Limitation

To the fullest extent permitted by law, those affiliated with Clinician On A Mission will not be liable for any damages arising out of or related to your use of the Websites. This includes, but is not limited to:

• Loss of data or interruption of services or discharge from services due to misconduct or inappropriate communication or behavior

• Inaccurate information provided on the Websites

• Third-party services or integrations

Exclusions

Clinician On A Mission’s liability is limited to the extent permitted by applicable law. Some jurisdictions do not allow certain exclusions or limitations of liability, and in such cases, these exclusions may not apply to you.

Total Liability

Clinician On A Mission’s total liability to you shall not exceed the amounts paid by you to Clinician On A Mission for services you receive.

Notices from Clinician On A Mission to You

Disclaimers

The information on this website was prepared by Clinician On A Mission. It is for informational purposes only, and is not intended to constitute, nor does it constitute, medical advice or treatment for any condition.

Use of this website does not create a therapeutic relationship nor a service relationship. A consultation to ensure that the service provider is the right “fit” for your unique needs is required prior to enrollment in services. Service agreements and informed consent procedures must be formally signed prior to diagnostic evaluation and start of services. It is the responsibility of the client to ensure that the service type they seeks is appropriate for their current needs and is approved by a licensed medical provider.

The website is not intended to be used for advice. Individual results are not guaranteed and no claims are made as to symptom improvement or progression. Clients reserve the right to discontinue services or decline to schedule future service appointments if they are unsatisfied with the results or quality of their care. Clients will be billed the full amount for all completed service appointments and sessions, including sessions terminated early due to inappropriate communication or misconduct. Clients have the right to file a formal complaint against the provider here.

Any decision(s) you make based upon information found here is not the responsibility of Clinician On A Mission. In accordance with, state licensing, ethical standards, and quality of care, the provider will recommend a higher level of care if clinically indicated based on symptom presentation at the time of service or session.

As a mandated reported in Massachusetts, Provider is legally required to notify the authorities if any client expresses intent, means and access to engage in self-harming behaviors, threatens someone else or in the case of disclosure of suspected abuse of a minor or elderly or disabled person. Provider will inform you if required to file any such claim.
